Please read these terms carefully before installing, hosting, or operating a ChatSpace Server instance.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("The User," "The Host") and ChatSpace Live ("We," "Us," "Our"), a software development entity based in the United Kingdom.
By downloading, installing, or executing the ChatSpace Server.exe ("The Software"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease use of the Software and remove it from your systems.
The Software is a decentralized chat server engine designed by Mark Hughes (NeO). While we provide the technology, you are the sole operator of your specific instance.
Subject to your compliance with these Terms, ChatSpace Live grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and run the Software for personal or community use.
You agree not to use the Software to:
Unlike traditional centralized platforms, ChatSpace Live does not host your chat room. You are the host.
As the Server Operator, you are solely responsible for all content, text, files, and media transmitted through your specific IP address and Port (7777). ChatSpace Live has no access to your private databases (`chatspace-pro-master.db`) and cannot moderate your community.
You agree to indemnify, defend, and hold harmless ChatSpace Live, its developers (Mark Hughes/NeO), and its affiliates from any claims, liabilities, damages, losses, or expenses arising out of your operation of a ChatSpace Hub. This includes, but is not limited to, actions taken by your users or legal data requests directed at your IP address.
The Software collects user IP addresses for the purpose of moderation (Banning/Kicking). As a UK-based entity, we remind you that if you host users from the UK/EU, you act as a "Data Controller." You must ensure you handle user IP addresses and chat logs in accordance with local laws.
The Software includes a feature known as "Hub Talk" which connects your instance to our Master Server (`jump.chatspace.live`).
By enabling "Client Mode" in your dashboard, you agree that your Server Name, Version, and online user count will be transmitted to the Master Server list. We reserve the right to ban specific Server IPs from the Master Hub if they are found to be spamming or abusing the "Hub Talk" protocol.
We do not guarantee that the Software will be error-free, that the "Hub Talk" master server will always be online, or that the Software is invulnerable to all forms of cyber-attack. You run this server at your own risk.
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
